FREQUENTLY ASKED QUESTIONS: 

We mediate a wide variety of employment-based disputes including but not limited to, claims of workplace discrimination or harassment alleging unfair treatment based on race, gender, age, disability, sexual orientation, or other factors; claims of retaliation; and claims of wrongful termination.  We do not mediate wage-and-hour, misclassification, or labor lawdisputes. 

We believe that virtual mediation is every bit as beneficial as mediation in person, sometimes even more so given the fact that parties may feel more relaxed in their own environments and the efficiency gained by parties not having to commute.  As a result, our default option is to conduct mediations via Zoom. 

When the parties would prefer to mediate in person, we believe meeting in a neutral space unaffiliated with either party is more conducive to equitable settlement negotiations.  For that reason, we conduct most of our in-person mediations at TARRA’s 9+CO Workspaces, conveniently located north of Cherry Creek.  TARRA offers free garage parking and is located within walking distance of numerous restaurants and cafés.   

Every mediation is unique and tailored to the particulars of each dispute and the parties’ preferences.  In most cases, we believe shuttle diplomacy (separating the parties into different  virtual or physical rooms after joint openings and introductions) is the most efficient way to steer the parties towards resolution.  Generally speaking, therefore, the phases of our mediations are as follows: joint welcome and instructions/explanations from the mediator; joint opening statements; private sessions or caucuses in separate rooms, during which time the mediator liaises between the parties; and joint drafting of a memorandum of understanding.  Of course, each case is different and the process is flexible. 

A Partial-Day mediation (from 9:00 a.m. to 1:00 p.m.) costs $750 per party for virtual mediation services, and $1000 per party for in-person mediation services.

This is a flat fee, regardless of whether the mediation takes one or four hours.

A Full-Day mediation (from 9:00 a.m. to 5:30 p.m., with a half-hour lunch break) costs $1500 per party for virtual mediation services, and $2000 per party for in-person mediation services.

This is a flat fee, regardless of whether the mediation takes the entire eight hours allotted.

All fees are due two weeks prior to the mediation.

After a mediation is scheduled, no cancellation fee shall be charged if the mediation
is cancelled at least 14 calendar days prior to the date scheduled for mediation.

Such cancellation must be in writing. If the mediation is cancelled within 14 calendar days of the date set for mediation, a cancellation fee of 50% per party shall be assessed.

The mediator may excuse the cancellation fee if the cancellation is due to medical reasons, court intervention, or an event beyond the parties’ control.
